With the assistance of the Public Interest Legal Foundation, a group of African-American citizens in New York City is suing the City Council over its recent decision to allow non-citizens to vote in local elections. Pointing out that the 15th Amendment protects the right of citizens to vote regardless of race or color, the lawsuit notes, “discriminatory intent may be established by proof that race was a motivating factor by proponents of the law.” Simply using demographic math shows that non-citizens in the city could easily control the outcome of elections regardless of the votes of American citizens, leading to a civil rights violation.
